ONLINE PRIVACY POLICY
We take your privacy very seriously. Please read this privacy policy statement carefully as it contains important information on who we are, how and why we collect, store, use, and share your personal information. It also explains your rights in relation to your personal information and how to contact us in the event you have a complaint.
1) WebSite.
a) Web Site Owner. Cali Barber L.L.C. ("Company") is the owner of this web site (βWebSite"). Company can be contacted by telephone at (615) 819-1969, by e-mail at beardz@calibarber,com, or by mail at 611 Commerce Street, Suite 2611, Nashville, TN 37203. This online privacy policy discloses Company information practices for this Web Site, including what type of personal identifiable information is collected, how the information is used, and with whom the information is shared.
b) Web Site Visits. In general, you can visit the Web Site without disclosing any personal information. Company may collect certain information from Web Site visitors. This may include, but is not limited to, the server domain name, e-mail address, type of computer and web browser, what pages visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.
c) Web Site Transactions. At times, Company will need personal information regarding a customer or client in order to process a subscription or purchase. It is Company's intent to inform you before Company collects personal information.
2) Personal Information That May Be Collected.
a) Identifying Information. In order to make a purchase within the Web Site, Company may ask a visitor to provide certain personal identifying information, which may include: name, mailing address, e-mail address, telephone number, method of payment, and, if applicable, credit card number. Company may request additional information necessary to establish and maintain customer's account.
b) Service Quality Monitoring. Some Web site transactions may require Company to contact a customer or client by phone. Company will not contact you by phone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Company's practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
c) Information from Children.Company does not collect or maintain information from users actually known to be under the age of 13, and no part of Company's Web sites are structured to attract anyone under the age of 13. Company will not collect or post information from a child known to be under the age of sixteen (16) without the written consent of a parent or guardian. Company does not knowingly use personally identifying information collected from children for marketing or promotional purposes, and does not disclose such information to any third party for any purpose whatsoever.
d) Lost or Stolen Information. Help us keep your personal information accurate. If your payment information and/or username and password changes or is lost or stolen, you should promptly notify Company in order to enable Company to cancel the lost or stolen information and to update its records with changed information.
e) Links to Other Web Sites. The Web site may contain links to other web sites. Company is not responsible for the privacy practices or the content of those other Web sites.
3) Uses Made of the Information.
a) Limited Uses Identified. Without your prior consent, Company will not use your personal identifiable information for any purpose other than that for which it is submitted. Company uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Company also processes billing and business requests related to Web Siteβs goods and/or services. Company may also use personal information collected from you for statistical analysis of customer's behavior, for product development, for content improvement, to customize the content and layout of the Web Site, and for internal company reviews.
b) Marketing Uses. The information you provide to the Web site may also be collected, used, analyzed and/or processed by Company, or selected third parties on Company's behalf, for marketing and other business purposes. If you do not want your personal identifying information used in this way, you may opt out of receiving such marketing material by following the instructions provided in the marketing materials or by contacting Company by e-mail at beardz@calibarber.com.
c) Promotional Communications. We may use your personal information to send you updates about our products and/or services, including exclusive offers, promotions or new products and/or services. We have a legitimate interest in processing your personal information for promotional purposes, which means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly. You have the right to opt out of receiving promotional communications at any time by contacting us by email at beardz@calibarber.com.
d) Stored Information Uses. Company stores the information entered on the Web Site. This information is used to compile a customer's purchase history in order to enable Company to recommend products, services, or special offers that would be of interest to a customer. Stored information is used by Company to support customer interaction with the Web site, to deliver purchases and/or services, and/or to contact the customer or client again about other Company services and products.
e) Online Advertising. Some companies that help Company deliver advertising may collect and use information about Company's customers to help Company better understand the types of advertising or promotions that are most appealing to Company's customers. If the customer would prefer that these companies not collect such information, you may notify Company by e-mail at beardz@calibarber.com.
4) Disclosure of the Information.
a) Within Corporate Organization. Company may share your personal information within the Company corporate organization.
b) Mergers and Acquisitions. For the purpose of developing and expanding its business, Company may share, rent, sell or buy business assets. In such transactions, customer information is generally one of the transferred business assets. Also, in the event Company is acquired, customer information will be one of the transferred assets.
c) Agents. Company may engage other companies and individuals to perform business functions on behalf of Company. These persons are provided with personal identifying information required to perform their functions, but are prohibited from using the information for other purposes.
d) Disclosure to Governmental Authorities. Company may release personal information to appropriate governmental authorities where release is required by law (for example, a subpoena) or by a regulation, or is requested by a government agency conducting investigations or proceedings.
5) Use of Computer Tracking Technologies.
a) No Tracking of Personal Information.Company'sWebsite(s) are not setup to track,collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but, again, the statistics contain no personal information and cannot be used to gather such information.
b) Use of Cookies. A cookie is a small amount of data that is sent to customer's browser from a Web server and is stored on the computer's hard drive. Company uses non- identifying cookies to provide easier site navigation. Company's Web site(s) can still be used if customer's browser is set to reject cookies. Company's cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you.
c) Use of Web Beacon Technologies. Company may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non- identifiable notice of that visit is generated which may be processed by Company or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer's visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
d) Collection of Non-Identifiable Information. Company may collect non-identifiable information from user visits to the Company Web site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Company Web site(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as "clickstream data." Company or its contractors may use this data to analyze trends and statistics.
e) Collection of Personal Information. Company collects personal identifying information from customer during a transaction. Company may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used to help Company understand trends and patterns and is not reviewed at an individual level.
6) InformationSecurity.
a) Commitment to Online Security. Company intends to protect customer personal information and to maintain its quality. To achieve information security and quality, Company implements appropriate measures and processes, such as using industry standard encryption technologies when transmitting certain sensitive information. We limit access to your personal information to those who have a genuine business need to access it.
b) No Liability for Acts of Third Parties. Company will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Company shall not be liable for unauthorized disclosure of personal information due to no fault of Company including, but not limited to, errors in transmission and unauthorized acts of third parties.
7) Privacy Policy Changes and Opt-Out Rights.
a) Changes to Privacy Policy. This privacy notice was last updated on March 27, 2023. Company reserves the right to change its privacy policy statement at any time. A notice of any material change will be posted on the Web.
b) Opt-Out Right. You have the right at any time to stop permitting personal information to be collected, used or disclosed by Company and/or by any third parties with whom Company has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Company by e-mail at beardz@calibarber.com. After processing the cancellation, Company will delete customer or prospective customer's personal information from its data base.
8) Access Rights to Data.
a) Information Maintained by Company. Upon your request, Company will provide a reasonable description of your personally identifiable information that Company maintains in its data bank. Company can be contacted by e-mail at beardz@calibarber.com.
b) Corrections and Changes to Personal Information. Help us to keep your personal information accurate. If your personal information changes, or if you identify an error after reviewing your information that Company has on file, please promptly e-mail Company at beardz@calibarber.com and provide the new or correct information.
Your California Privacy Rights. California's privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits Companyβs customers or clients who are California residents to request certain information regarding Company's disclosure of personal information for their direct marketing purposes. To make such a request, please write to: beardz@calibarber.com. Within thirty (30) days of receiving such a request, Company will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Company reserves its right not to respond to requests submitted other than to the address specified in this paragraph.
9) Accountability.

b) Terms of Use. If you choose purchase Companyβs products and/or services, customer's action is hereby deemed acceptance of Company practices described in this policy statement. Any dispute over privacy between a customer or client and Company is subject to the provisions of this notice and to Company's Terms of Use Agreement which is incorporated into this Online Privacy Policy statement and can be read at www.calibarber.com.

TERMS OF SALE
These Terms of Sale apply to your online shopping experience with Cali Barber L.L.C. If you do not agree to these Terms of Sale (βTermsβ), please do not place an online order from Cali Barber L.L.C. (which we may refer to as βCali Barber L.L.C.,β we,β βus,β or βourβ).
By placing an online order with us, you are agreeing to be bound by these Terms. If you do not agree to these Terms, please do not make a purchase from us and/or return any eligible purchase within the return window described in these Terms.
Terms of Sale
1. Applicability of these Terms of Sale. These Terms of Sale (βTermsβ) apply to your orders, purchases, and returns at our physical location (a βRetail Storeβ), and our website that allows you to place an order online (βOnline Storeβ). Retail Stores and Online Stores are collectively referred to in these Terms our βStoresβ.
2. These Terms create a legally binding agreement between you and Cali Barber L.L.C. These Terms create a legally binding agreement between you and Cali Barber, LLC with its headquarters and principal place of business at 611 Commerce Street, Suite 2611, Nashville, TN 37203. We may revise these Terms of Sale at any time. The current Terms of Sale will be posted here at www.calibarber.com. The Terms of Sale posted at the time you purchase products from our website will apply to that purchase. In addition to these Terms of Sale, by shopping and/or purchasing from our website you acknowledge and agree to by bound by Cali Barber L.L.C.βs Terms of Use and Privacy Policy, which are incorporated into these Terms.
3. Shopping with us online. To complete your purchase at our Online Store, you must provide your full name, e-mail address, valid shipping address, and payment method to place an online order. When you submit an order, we will send an email acknowledging receipt of your order (βOrder Confirmationβ). Our acceptance of your order takes place when the products are shipped to you; we will send a second email confirming that the products have been shipped. If we are unable to supply you with a product, we will notify you by email and will not process the order for that product.
4. Price. The total price specified in the final check out screen on our Online Store includes estimated tax and shipping costs (if applicable). This price, updated to include actual tax, will be recorded in the order confirmation for Online Store orders. If you pay by credit or debit card, the total amount for your entire purchase will be reflected on your statement.
5. Payment Methods. The product prices displayed on the website do not include sales tax. Shipping rates are applied per order. We accept several payment methods at check out. Please do not try to pay using any payment method not posted at our Stores. If you do, we will not be liable for any loss of the payment or any other damages that may result from this action. If you pay by credit or debit card, we will deduct the full purchase amount from your account when your order is placed.
6. Shipping and Delivery. We only ship orders to valid delivery addresses within the United States. Upon delivery, please inspect the packaging and products for damage. If it appears that the products are damaged, please do not accept the shipment, and contact us for assistance.
7. In Person Order Pick Up. Online orders may be picked up in person at 5714 Edmonson Pike, Studio 23, Nashville, Tennessee 37211. At checkout, βIn Person Pick Upβ must be selected for the order to qualify for in person pick up. The delivery method cannot be changed once checkout is complete.
8. RETURN POLICY
We are proud of our products and stand behind them 100%. That being said, not every scent or every product is for everyone.
If you've received a product and are unhappy with it for any reason, you are free to return the item to us by mail up to 14 days after the purchase date. Once we receive the items back, we will issue you a refund for your item(s) minus the original shipping cost we paid the carrier to originally ship the items to you. You are responsible for paying for your own shipping cost for returning your items. Shipping cost are non-refundable.

Shipping and return shipping charges will not be refunded in these instances and are the responsibility of the customer. Returned orders shipped under our "Free Shipping" promotion will have all shipping costs incurred by calibarber.com deducted from any refund.
We go to great lengths to fill your order as accurately, and as quickly as possible. Once an order is shipped, the shipping charges are non-refundable, and go directly to the carrier delivering the package.
RETURN AUTHORIZATION:
In the event that you would like to return your product, please contact beardz@calibarber.com Please include the following information: Order Number, Full Name, Phone Number or Email Address, and Reason for Return. We will provide you with detailed instructions on how to process the return.
DEFECTIVE OR INCORRECT PRODUCTS:
If you've received a defective or incorrect item in your shipment, please contact us via email at beardz@calibarber.com our customer service representatives will authorize a return or replacement. You will NOT be charged shipping charges for any mistakes we make while preparing your shipment.
9. We have the right to reject your purchase or cancel your online order. Sale of products and fulfillment of all orders at our Stores is subject to availability and our discretion in managing inventory. We explicitly reserve the right to limit, decline or reject any sales and orders for any reason, without being liable for any damage or costs other than refunding the amount for the order.
10.Title transfer and risk of loss. Title and risk of loss for products purchased from our Online Store pass to you upon delivery of the order to you. Title and risk of loss for products purchased from our Online Store and picked up in person, will pass to you upon your receipt of those products. Title to the products will not transfer until full payment has been received.
11.Indemnification and Release. You agree to defend, indemnify, and hold harmless Cali Barber L.L.C., its agents, subsidiaries, affiliates, licensors, licensees, service providers, employees, agents, officers, and directors (the βIndemnified Partiesβ) from and against all claims, losses, liabilities, expenses, damages and costs, including, without limitation, attorneys' fees, arising from or relating to your conduct in connection with any of our Stores, or any violation of these Terms of Sale, any law or the rights of any third party. You further agree to defend and indemnify any and all loss, damages, judgments, awards, costs, expenses and attorneyβs fees of the Indemnified Parties. You, for yourself and on behalf of your heirs, estate, insurers, successors and assigns, hereby fully and forever release and discharge the Indemnified Parties from any and all claims or causes of action you may have for damages arising from or relating to your conduct in connection with any of our Stores.
12.Limitation of Liability. These Terms of Sale set out the full extent of our agreement and understanding with respect to any claim arising from, or related to, your shopping, orders, purchases, returns, access, or use of our Stores. To the extent permissible by applicable law, the maximum aggregate liability of Cali Barber L.L.C. arising from or relating to these Terms, whether in contract, warrants, tort, strict liability, statute, or otherwise, shall be limited to the amount you paid to us for the products purchased in the relevant transaction. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE AND ACCESS TO OUR STORES. YOUR ONLY REMEDY AGAINST CALI BARBER L.L.C. IN CONNECTION WITH ANY ALLEGED DAMAGES ARISING FROM YOUR USE OR ACCESS TO ITS STORES OR ANY CONTENT IS TO STOP USING OR ACCESSING ITS STORES. IF ANY PART OF THIS LIMITATION OF LIABILITY IS DETERMINED TO BE UNENFORCEABLE OR INVALID FOR ANY REASON, YOU AGREE THAT CALI BARBER L.L.C.βS LIABILITY TO YOU FOR ANY DAMAGE OR LOSS SHALL BE LIMITED TO THE FULLEST EXTENT ENFORCEABLE BY APPLICABLE LAW AND THESE TERMS.
13.No warranties. Cali Barber L.L.C. provides access to its Stores on an "as is" and βas availableβ basis and do not make any warranty, express, implied, limited, or other, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, or non-infringement for any product and on all purchases. All such representations and warranties are expressly disclaimed.
14.Dispute Resolution; Jurisdiction; Venue; Attorney Fees. This Agreement, or any dispute arising from this Agreement, is governed by the laws of Tennessee, without regard to provisions of conflicts of law. Any lawsuit arising from or related to this Agreement shall be brought exclusively before the state or federal courts for Davidson County, Tennessee, and you hereby consent to the jurisdiction of any such court. The prevailing party in any such action shall be entitled to recover its reasonable attorneys' fees and costs incurred in litigating or otherwise settling or resolving such action. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF, OR RELATED TO, YOUR USE OF THIS WEBSITE OR THIS AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.
15.Right to Assign; Severability; Waiver; Entire Agreement. Cali Barber L.L.C. may assign its rights and duties under these Terms to any party at any time without notice to you, unless notice is required by applicable law, but this will not affect your rights or our obligations under these Terms. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unlawful, void, or
unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. The failure of Cali Barber L.L.C. to exercise or enforce any right or provision of this Terms shall not operate as a waiver of such right or provision. These Terms constitutes your entire Agreement with Cali Barber L.L.C. with respect to any shopping and purchase activities.
16.These Terms of Sale may change at any time. These Terms of Sale are subject to change at any time at Cali Barber L.L.C.βs discretion. Your continued access and use of our Store constitutes your acceptance of the changes to the Terms of Sale. The most current version of this Agreement replaces all previous versions.
17.Confidentiality. It is our policy to release a userβs personal identifying information and any other information when we reasonably believe such disclosure is appropriate to comply with applicable law, to enforce any of our contracts or agreements, to protect the rights, property or safety of our users and customers, in response to a governmental authority request or legal process, or for purposes of fraud protection. By accepting these Terms of Sale, you waive all rights and agree to hold Cali Barber L.L.C. harmless from any claims resulting from any action taken by Cali Barber L.L.C. during or as a result of its investigations, and/or from any actions taken as a consequence of investigations by either the Website or law enforcement authorities.
